BERNAMA retains the right to amend, change, modify or alter the terms and conditions herein contained or any part thereof, or to impose new conditions including but not limited to, adding fees or charges for use of certain services. The access to the web site is allowed on the express condition that BERNAMA shall not be responsible in any, manner whatsoever for any damage, injury or loss caused to or suffered by the user arising out of the purchase use of viewing of any products or service thereon.

• The Supplier hereby covenants to do its utmost to ensure the accuracy, reliability and speedy delivery of the Said Service.
• The Subscriber hereby acknowledges and agrees that there may be delays, omissions or inaccuracies in the Said Service. Neither the Supplier nor its employees, agent contractors and/or Information Providers :
• Shall be held liable to the Subscriber or any third party for any loss or injury caused in whole or part by their interpreting, editing, writing, reporting or delivering the Said Service nor will they be liable for damages caused by any failure of performance, mistakes, omissions, interruptions, deletions of files, defects, delays in operation or transmissions, communication lines failure, theft, destruction or unauthorized access to or use of the Said Service howsoever arising.
• have given any warranties of any kind whatsoever as to the fitness, capacity or conduct of any other subscriber or information provider contributing information to the Said Service and shall not be liable to the Subscriber or any person claiming through the Subscriber for any use or abuse of the Said Service by another Subscriber or Information Provider.
• Both parties shall indemnify each other against any loss, claim, cost, expense, demand or liability by a third party arising from the provision of the Said Service.
• The Said Service is supplied on condition that the Subscriber :
• will not use or permit the use of the information contained in the Said Service, for any illegal purpose;
• will use the information contained in the Said Service only in the course of its own business (which shall not include redissemination);
• will not cause or permit such information to be recirculated, republished, retransmitted, broadcasted posted on the internet outside the Premises in any form; and
• is aware that the information and publications available from the Said Service is the property of the Supplier and/or the Information Provider and is copyright material and that the Subscriber shall at all times observe the rights pertaining to the same.
• Any breach by the Subscriber of paragraph (d) will entitle the Supplier, in addition to any other remedy it may have to :
• terminate this Agreement immediately without further obligation to the Subscriber, and
• seek complete indemnity for any damage suffered as a result of such breach. The Subscriber shall assist the Supplier to obtain any consents necessary for the Said Service to be operated at Subscriber's premises and to enable the Subscriber to pay the Supplier the subscription whether such consents issue from governments, exchanges, telecommunication authorities, banking authorities, and/or other regulatory bodies and will comply with any terms attached thereto, provided that the Supplier shall not be liable in anyway for any expenses or loss incurred by the Subscriber on account of the failure to receive such consent.

• The Supplier hereby reserves the right to withdraw any new service and/or any part of the existing service at its absolute discretion by giving three months advance notice in writing to the Subscriber. Notwithstanding the aforesaid this Agreement shall continue to be effective in respect of any Service and/or part of any service not withdrawn.
• In cases where the provision of the Service or part thereof is dependent upon Agreement made between the Supplier and third parties and in the event that the said Agreement is terminated for any reason whatsoever, then the Supplier may likewise immediately terminate this Agreement or the relevant part thereof without any further obligation to the Subscriber thereafter.
• Upon termination pursuant to Clause 2 (a) and/or 2 (b) hereof the Supplier shall refund proportionate part of the Subscription (if any) already paid in respect of the Service or part of the Service or part thereof which has been canceled or withdrawn.
• In the event of any breach of this Agreement by the Subscriber, which cannot be remedied or is not remedied within thirty (30) days of the Subscriber being requested to do so, the Supplier, in addition to any other remedy it may have, may terminate this Agreement immediately.
• The Subscriber shall not use or permit the use of the Said Service in any way not authorized by this Agreement.

• The Subscription, ancillary charges and all other sums payable hereunder shall be paid without any demand to the Supplier on or before the seventh day of each month from the date first above written (herein after referred to as " the Due Date") for the duration of this Agreement.
• In the event that the Subscriber fails to pay the monthly subscription or any other sums payable hereunder on the due date. The Supplier shall be entitled to charge interest on the unpaid sum at the rate of one and half percentum (1.5%) per month calculated daily on any sums outstanding beyond the said date.
• Upon termination of this Agreement the Supplier shall have the right to utilize all or part of the deposit to offset any arrears due to the Supplier.
• In addition to the Subscription, the Subscriber shall pay:
• Any sales, use, added value, property, withholding or similarly taxes, payable in respect of the Said Service or any part thereof, and/or the provision of the Service or otherwise arising in respect of this Agreement.
• Stock and commodity or other applicable exchange fees, and all telecommunication charges including rentals for lines and terminal equipment;

• Performance of any obligation by the Parties will be excused if prevented by circumstances beyond the reasonable control of the party claiming such event.
• All notices will be sent by e-mail as specified in the registration form or address as in this Agreement.
• Failure of either party to exercise any right or remedy under these conditions does not signify acceptance of the event giving rise to such right or remedy.
• All disclaimers by and indemnities in favour of both partier shall survive the termination of this agreement.
• This Agreement shall be governed by the Laws of Malaysia.
• This Agreement contains the entire understanding of the parties to the exclusion of any and all prior or collateral agreements or understandings whether oral or written. No subsequent variation of this Agreement shall have effect unless expressly agreed to in writing by both parties.
• Under no circumstances shall the Supplier be liable for any indirect or consequential damages arising out of or in connection with the provision of the Said Service to the Subscriber.
• The Subscriber shall not transfer or assign or let its rights under this Agreement to any third party without prior consent of the Supplier which consent shall not be unreasonably withheld.

• The subscriber shall be responsible to purchase, install and maintain their own equipment, telecommunication lines, modems etc. for the service to be delivered to them via the Internet.
